FOIL REQUEST

Pursuant to the New York State Freedom of Information Law (FOIL) I hereby request all of the following documents.

1.All correspondence between James Coniglio and any representative of Newman Development Group, McCann Development, or Ferrera/Jerum related to the drafting or content of the Planned Development District (PDD) law. This request is made pursuant to Mr. Coniglio’s statement in the June 28, 2007, Livingston County News that “Newman actually offered criticisms of the law which we rejected.”

2.All other correspondence, whether by letter, fax, or email (including attachments), or notes from meetings or phone conversations, between James Coniglio and any representative of Newman Development Group, McCann Development, Ferrera/Jerum, or APD Engineering, between December 1, 2004 and July 1, 2007.

3.All correspondence, whether by letter, fax, or email (including attachments), involving Newman Development Group, McCann Development, or Ferrera/Jerum, sent or received by Helen Zamboni, either as an original correspondent or as a secondary party receiving the correspondence of others.

4.All correspondence, whether by letter, fax, or email (including attachments), involving Newman Development Group, McCann Development, or Ferrera/Jerum, sent or received by any elected official of the Town of Geneseo, either as an original correspondent or as a secondary party receiving the correspondence of others.

5.The contents of the “client files” developed by Underberg & Kessler for the Town of Geneseo related to the Planned Development District law or Newman Development Group.

6.All correspondence, whether by letter, fax, or email (including attachments), between Greg Lamb, Mary Bondell Lamb, Reverdy Munson, Wildroff Bondell, or Gary Munson, and James Coniglio, Weston Kennison, or the Town of Geneseo.

Please note that this request exempts any and all materials already provided to William Lofquist or PDDG pursuant to previous FOIL requests. Also exempted are any and all materials submitted by Newman Development Group to the Town of Geneseo or the Town of Geneseo Planning Board as part of the formal submission of its application for PDD zoning.

Should any of these documents be determined to be missing, please perform a diligent search. Should the documents remain missing, please provide certification, in the form of an affidavit, of their status as missing.
